Terms of Service

1. Parties and Definitions

• Company / Service provider: Şimşek Via Otomotiv Turizm Organizasyon Sanayi Ticaret Limited Şirketi (trading as ViaGo Transfer)
• User: any natural or legal person accessing the platform and using the services
• Consumer: a natural person purchasing the service for non-commercial, non-professional purposes
• Agency / Partner: a commercial business purchasing services through the B2B channel
• Platform: www.viagotransfer.com and its associated applications

2. Description of Services

ViaGo Transfer operates under Travel Agency Licence No. 11452 (A Grubu) issued by the Turkish Ministry of Culture and Tourism, and provides:

• Airport transfers (Istanbul Airport, Sabiha Gökçen and other airports)
• Private city and intercity transfers
• VIP, Business and Standard class vehicle hire with driver
• Group transfers (minivan, midibus, coach)
• Bulk booking and operations management through the B2B agency panel
• Invoicing, reconciliation and reporting infrastructure

3. User Obligations

• Ensure that all information you provide is accurate, current and complete
• Keep your account credentials confidential and do not share them with third parties
• Use the platform in accordance with the law, public order, morality and the rules of good faith
• Refrain from conduct that infringes the rights of other users or third parties
• Do not attempt unauthorised access, automated data collection (scraping), reverse engineering or injection of malicious software
• Share third parties' personal data (passenger details, etc.) only where you have the necessary legal permissions

4. Booking, Pricing and Payment

• All prices are shown in Turkish Lira (TRY) or Euro (€), VAT included unless stated otherwise
• The booking fee is collected at the time of purchase or before the service, according to the stated conditions
• Payments are taken through PCI DSS certified virtual POS / iframe payment services; we never store your card details
• Bookings may be suspended where collection fails due to the bank or card provider
• Separate payment and reconciliation terms apply to agency / B2B users

5. Intellectual Property

All content, design, logos, trademarks, software, databases and infrastructure on the platform are owned by or licensed to Şimşek Via Otomotiv Turizm Organizasyon Sanayi Ticaret Limited Şirketi. Copying, reproducing, distributing, creating derivative works or commercial use without permission is prohibited. Infringements are pursued under Law No. 5846 on Intellectual and Artistic Works and Industrial Property Law No. 6769.

6. Scope and Limitations of the Service

• The Company may temporarily suspend the service for maintenance, security updates or force majeure
• Prices and service conditions may change without prior notice; however, confirmed bookings remain subject to the conditions in force at the time of confirmation
• The Company reserves the right to suspend or terminate accounts that breach these Terms
• The Company's liability is limited for delays or cancellations caused by traffic, weather, accidents, force majeure or other circumstances beyond its control

7. Limitation of Liability

The Company does not warrant that the services will be uninterrupted or error-free. The Company's total liability is limited to the price of the service concerned. The Company is not liable for damages arising from force majeure, third-party service providers or the user's own fault. This clause does not remove consumer rights under Consumer Protection Law No. 6502 or other mandatory legislation.

9. Changes to these Terms

The Company may update these Terms without prior notice. Changes take effect once published; continuing to use the platform means you accept the current terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the Istanbul (Central) Courts and Enforcement Offices. Consumers retain their right to apply to the Consumer Arbitration Committees and Consumer Courts under Law No. 6502.
