This Distance Sales Agreement (the "Agreement") has been drawn up in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation published in Official Gazette No. 29188 of 27 November 2014. By creating a booking through ViaGo Transfer, you confirm that you have read, understood and accepted all provisions of this Agreement electronically.
1. Parties

1.2 Buyer
The natural or legal person who purchases a transfer service through the ViaGo Transfer website, mobile application or call centre, and who provides their identity, contact and invoicing details electronically when the Agreement is formed.
2. Subject of the Agreement
This Agreement sets out the rights and obligations of the parties in relation to the sale and performance of the transfer service ordered electronically by the Buyer through the Seller's website www.viagotransfer.com, with the characteristics, sale price and payment method set out below.
3. Essential Characteristics of the Service
The service is provided in accordance with the details selected by the Buyer at booking:
- Pickup and drop-off points (airport, hotel or full address)
- Transfer date and time
- Vehicle class (Standard / Business / VIP / Minivan / Minibus, etc.)
- Number of passengers, luggage and special requests (child seat, name sign, etc.)
It is a point-to-point passenger transport service performed with a licensed driver and an insured vehicle. Information about the essential characteristics and the total price is also set out on the booking page and in the confirmation e-mail.
4. Price and Payment Terms
- The price is shown to the Buyer at booking in Turkish Lira (TRY) or Euro (€), VAT included
- Payment is taken by credit card, debit card, bank transfer or another method accepted by the Seller
- Card details are processed through PCI DSS certified virtual POS / iframe payment infrastructure; the Seller does not store card data
- Where bank approval / 3D Secure verification is not obtained, the booking is not deemed to have been formed
5. Formation and Performance
- The Agreement enters into force when the Buyer completes payment and the Seller sends the booking confirmation e-mail
- The Seller undertakes to perform the service on the date and at the time stated in the booking
- The Seller's liability is limited in the event of force majeure, weather conditions, traffic, or delays caused by the Buyer (late arrival, wrong address, missing information, etc.)
6. Right of Withdrawal and its Exception
Important — exception to the right of withdrawal: under Article 15(g) of the Distance Contracts Regulation, "contracts relating to accommodation, the transport of goods, car rental, the supply of food and beverages, and the use of leisure time for entertainment or recreation, which must be performed on a specific date or period" fall outside the right of withdrawal. Since a transfer is a passenger transport service performed on a specific date and time, the 14-day right of withdrawal does not apply to this Agreement.

7. Responsibilities
7.1 Obligations of the Seller
- Perform the service on the agreed terms, with a licensed driver and an insured vehicle
- Notify the Buyer within a reasonable time when service details must change
- Provide 24/7 customer contact (by phone and electronic channels)
- Process the Buyer's personal data in accordance with the KVKK and related legislation
7.2 Obligations of the Buyer
- Provide accurate and complete booking details (flight number, phone, pickup address, etc.)
- Be ready at the pickup point at the stated time
- Refrain from conduct that may harm the vehicle or other passengers
- Not request the carriage of unlawful substances, materials or animals
- Obtain the necessary legal permissions before sharing third parties' personal data (passenger details, etc.)
8. Invoicing and Tax
- Following collection of the price, an e-invoice or e-archive invoice is issued under the Tax Procedure Law and related communiqués
- The invoice is issued using the details provided at booking; subsequent changes must be notified to the Seller within 7 business days

9. Data Protection
The Buyer's personal data is processed for the purposes and under the conditions set out in the Seller's Privacy Policy, in accordance with the KVKK and related legislation.
10. Dispute Resolution
For disputes arising from this Agreement, the Consumer Arbitration Committees at the Buyer's place of residence have jurisdiction within the monetary limits in force, and the Consumer Courts above those limits. For buyers who are not consumers, the Istanbul (Central) Courts and Enforcement Offices have jurisdiction.

11. Entry into Force
This Agreement is recorded digitally by ViaGo Transfer systems upon the Buyer's electronic approval and completion of payment. Its provisions are summarised in the booking confirmation e-mail sent to the Buyer.
